These terms and conditions govern access to and use of the website ecadrial.com and the services offered by Ecadrial Capital Inmobiliario S.A.S., with tax ID (RUC) 1793214508001 and registered office in Quito, Ecuador.

1. Purpose

Ecadrial operates a technology platform that connects individual lenders with real estate developers seeking financing backed by real guarantees over properties located in the territory of the Republic of Ecuador.

2. Acceptance

Access to and use of the website imply full acceptance of these terms. If you do not agree with any of their clauses, you must refrain from using the site and the services.

3. Requirements to lend

To act as a lender you must: (i) be of legal age (eighteen years old); (ii) be a natural or legal person resident in Ecuador or in an allowed country; (iii) have legal capacity to contract; (iv) complete the identity verification and due diligence process established by Ecadrial.

4. Risks of real estate crowdlending

The lender acknowledges that real estate crowdlending involves risks, including: credit risk (the developer may fail to repay principal or interest), market risk (fluctuations in the value of the collateral), liquidity risk (inability to recover the capital before maturity) and operational risk. Historical returns do not guarantee future returns.

5. Fees

Ecadrial does not charge fees to the lender for the origination of the loan. Fees are charged to the real estate developer for structuring, publication and follow-up, and are disclosed on each project sheet.

6. Intellectual property

All the content of the site (texts, graphics, logos, source code) is the property of Ecadrial or its licensors and is protected by Ecuadorian intellectual property laws and applicable international treaties. Any reproduction, distribution or modification without express written authorisation is prohibited.

7. Liability

Ecadrial acts as a technology platform and does not guarantee the return or repayment of loans. Ecadrial shall not be liable for losses arising from lending decisions made by the user or from acts of God or force majeure.

8. Anti-money laundering

Ecadrial complies with the Ecuadorian Organic Law on the Prevention, Detection and Eradication of the Crime of Money Laundering and the Financing of Other Crimes, and with the resolutions of the Financial and Economic Analysis Unit (UAFE). Users agree to provide truthful and up-to-date information.

9. Amendments

Ecadrial reserves the right to modify these terms and conditions at any time. Changes will take effect from their publication on the website. Registered users will be notified by email.

10. Governing law and jurisdiction

These terms are governed by the laws of the Republic of Ecuador. For any dispute related to the interpretation or performance of these terms, the parties submit to the jurisdiction of the competent judges of the Quito canton, expressly waiving any other forum.
