Ecadrial Capital Inmobiliario S.A.S. (hereinafter, Ecadrial), with tax ID (RUC) 1793214508001 and registered office at Av. República de El Salvador N36-84 y Naciones Unidas, Mansión Blanca Building, Floor 8, Office 802, Quito, Ecuador, is responsible for the processing of personal data collected through the website ecadrial.com.
1. Data we collect
We collect the following personal data: first and last name, email address, phone number, ID card or passport number, banking details for the payment and collection of interest, postal address and browsing data (IP address, browser type, pages visited). This data is voluntarily provided by the user through our forms or automatically generated during browsing.
2. Purpose of the processing
We process your personal data to: manage your registration and verification as a lender, execute loan agreements, comply with anti-money laundering and counter-terrorism financing regulations, send you commercial communications about new projects if you have given your consent, respond to enquiries and requests, and comply with legal, accounting and tax obligations.
3. Legal basis
The processing of your data is based on the performance of the loan agreement, compliance with legal obligations established by the Ecuadorian Organic Law on Personal Data Protection (Official Registry Supplement 459 of 26 May 2021) and its Regulations, and the express consent granted by the user for the sending of commercial communications.
4. Data retention
We retain your personal data for the time necessary to fulfil the purpose for which it was collected and to determine possible legal, accounting or tax liabilities, with a minimum period of ten (10) years from the end of the contractual relationship, as required by Ecuadorian anti-money laundering regulations.
5. Recipients of the data
We may share your data with: banking entities for payment processing, competent authorities (Internal Revenue Service, Superintendency of Companies, Financial and Economic Analysis Unit), technology service providers under a data processing agreement, and external auditors. We will never sell your data to third parties for commercial purposes.
6. Rights of the data subject
In accordance with the Organic Law on Personal Data Protection, you have the right to access, rectify, erase, oppose, port your data, not to be subject to automated decisions and to withdraw consent. You can exercise these rights by writing to privacidad@ecadrial.com, attaching a copy of your ID. You can also file a complaint with the Ecuadorian Superintendency for the Protection of Personal Data.
7. Security
We apply technical and organisational measures to protect your personal data against unauthorised access, loss, alteration or destruction. We use TLS 1.3 encryption for all communication, encrypted storage at rest and access controls based on the principle of least privilege.
8. Minors
The website and services provided by Ecadrial are aimed exclusively at persons over the age of eighteen (18). We do not knowingly collect personal data from minors.
9. Changes to the policy
We may update this privacy policy to adapt it to legislative changes or service improvements. The current version will be published on this page with the date of the last update.
